Terms of Service & EULA

Please review these Terms of Service and End User License Agreement ("Terms", "Agreement", or "EULA") carefully before accessing or using the GatherBiz mobile applications, web platforms, or associated synchronization services (the "Service"), owned and operated by GATHERBIZ (PTE. LTD.) ("GatherBiz", "we", "us", or "our"), a company incorporated in Singapore (Registered Office: 60 Paya Lebar Road, #11-22 Paya Lebar Square, Singapore 409051, Singapore).

By downloading, installing, accessing, or using GatherBiz, you agree to be legally bound by these Terms. If you do not accept these Terms, do not install or use the Service.

1. User Accounts & Verification

• Registration: To access collaborative features, you must register using a verified international mobile number in E.164 format (e.g., +65XXXXXXXX) and password credentials. You must provide truthful and accurate information.
• Account Security: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorized access.
• Age Limit: You must be at least 13 years old (or the legal age of majority in your jurisdiction) to use the Service.

2. End User License Agreement (EULA) Grant

• Limited License: Subject to your adherence to these Terms, GatherBiz grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and run the application on mobile and desktop devices you control for collaborative personal use.
• Restrictions: You shall not reverse engineer, decompile, distribute, rent, lease, or create derivative works of any portion of the software, except to the extent permitted by applicable open-source components.

3. User-Generated Content & Zero-Tolerance Policy (Apple Guideline 1.2 Compliance)

GatherBiz allows users to create travel itineraries, share tasks and notes, upload photos, and collaborate within groups. To ensure a safe community, we enforce strict content rules in accordance with Apple App Store Review Guideline 1.2 and Google Play Developer Policies.

A. Prohibited Content

You agree not to upload, store, publish, share, or transmit any content that:

• Is defamatory, libelous, abusive, stalking, harassing, threatening, or harmful.
• Promotes hate speech, violence, racism, religious intolerance, or discrimination.
• Contains nudity, sexually explicit material, pornography, or child sexual abuse/exploitation.
• Depicts illegal drug consumption, violence, weapons trafficking, or criminal activities.
• Infringes upon third-party copyrights, trademarks, privacy rights, or trade secrets.
• Distributes spam, malware, spyware, or deceptive communications.

B. Reporting & 24-Hour Moderation Protocol

• In-App Reporting: Any user can report inappropriate content or abusive profiles directly inside the app by opening the item options or via Settings > Report Abuse / Objectionable Content. Alternatively, reports can be emailed to [email protected].
• 24-Hour Moderation Action: Our moderation team investigates every report. We commit to reviewing reported material and taking definitive action — including the immediate removal of offending content and the permanent ejection/banning of the offending account — within 24 hours of receiving a verified report.

C. User Blocking Mechanism

Users have the unrestricted right to block any user at any time. Blocking immediately suppresses all future friend requests, group invitations, and shared workspace visibility from the blocked user.

4. Intellectual Property Rights

• GatherBiz Rights: All software source code, database architectures, user interface designs, trademarks, and logos are the proprietary property of GatherBiz Pte. Ltd.
• Your Content Ownership: You retain ownership of your photos, travel itineraries, and notes. By uploading content to shared workspaces, you grant us a worldwide, royalty-free license solely to store, synchronize, and transmit that content to your authorized collaborators.

5. Termination & Account Deletion

• Termination by You: You may permanently terminate your account at any time via Settings > Danger Zone > Delete Account or by submitting a web request at https://gatherbiz.com/delete-account.
• Termination by Us: We reserve the right to suspend or terminate accounts that breach these Terms, upload prohibited content, or violate community safety standards without prior notice.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. GatherBiz Pte. Ltd. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or defect-free operation.

7. Limitation of Liability

To the fullest extent permitted by applicable law, GatherBiz Pte. Ltd. and its directors, employees, or partners shall not be liable for any indirect, special, incidental, or consequential damages resulting from your access to or inability to access the Service.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
